Bail, no jail for now: Salman Khan case puts question mark over legal process.

Admitting Bollywood superstar Salman Khan's appeal against his five-year prison sentence today,The Bombay High Court’s order suspending the five-year imprisonment given to the 2002 hit-and-run case convict actor Salman Khan is bound to raise many eyebrows.
 
It’s an irony that the trial court took 13 long years to nail the culprit and the High Court freed the convicted actor within hours.

"Not only must Justice be done; it must also be seen to be done." The HC’s order saving Khan from incarceration appears to go against this age-old principle followed by courts.

While admitting the actor’s appeal, Justice Abhay Thipsay said it would be proper to suspend the sentence during the pendency of the convict’s appeal as it raised “arguable points needing consideration”.

Courts decide cases on the basis of evidence and evidence alone. They don’t go by public perception and they must not do so. What they must take into account is the fact that the rule of law also implies equal treatment before law lest public confidence in the judiciary is undermined.

An Indian court has sentenced Bollywood star Salman Khan to five years in jail for killing a homeless man in a 2002 hit-and-run driving incident in Mumbai.
The judge said 49-year-old Khan was driving the car at the time of the accident and the defence’s contention that his driver Ashok Singh was at the wheel was not probable.

“You were driving the car without a licence and you were under the influence of alcohol," Deshpande told a courtroom packed with Khan’s family members and journalists.

The actor is one of Bollywood's biggest stars, appearing in more than 80 Hindi-language films. Several of his films, including Dabangg, Ready, Bodyguard, Ek Tha Tiger, Maine Pyar Kiya and Hum Aap Ke Hain Kaun, have been huge commercial hits.

Salman Khan finds a good friend.Bollywood actor Salman Khan, who is known to have on-off relationships, seems to have a new friend in Southern actor Daisy Shah. 

Even at the age of 47, Salman Khan's popularity with girls half his age, never seem to die down. Onlookers at Lavasa, where Salman has been shooting for his upcoming film Mental helmed by Sohail Khan, say that the star and his heroine Daisy Shah (who is in her mid-20s) have been taking intimate walks and even going for bicycle rides during their free time.
 A source from the small town close to Lonavla says, "Salman really likes spending time with Daisy these days. They go on bicycle rides during the late hours of the night." Sallu has been known to be on rather friendly terms with most of his female co-stars. Is this the start of a new friendship? Only time will tell.

The actor was shooting an action sequence at the ND Studio, when he suffered a wardrobe malfunction. However, Salman, being Salman, continued with the job at hand without stopping the shoot..Sohail Khan's film 'Mental' will release on October 2. Court To Hear Salman Khan's Plea On Hit-And-Run Case

Court to hear Salman Khan's plea On Hit-and-run case.  Bollywood Dabangg Salman Khan's hearing today in the Court.A Mumbai sessions court is expected to hear the revision application filed by actor Salman Khan in the 2002 hit-and-run case. The application challenges a magistrate court order that changed the charges against him from death by negligence to culpable homicide.The actor had not been summoned to appear before the court and the matter would be argued by his lawyers, sources said. The actor has contended the magistrate erred in invoking IPC section 304 part-II, offences under which are triable by a sessions court and attract 10 years imprisonment. He said the magistrate failed to appreciate that he had neither the intention (to kill people) nor the knowledge that his rash and negligent driving would kill. Earlier, Salman was tried by a magistrate for causing death by negligence (section 304 A) that provides for two years in jail.After examining 17 witnesses, the magistrate concluded culpable homicide charge was made out against the actor and transferred the case.
